Iberia to be probed over cancellation of air tickets sold in 2021

Air carrier Iberia has 20 days to provide explanations. The company may be fined at BRL 12 million.

Brazil government has opened an administrative inquiry to probe into alleged noncompliance committed by company Iberia Líneas Aéreas de España S/A. The investigation should focus on the cancellation of tickets sold in December last year as part of special deals.

The tickets purchased had flights from Rio de Janeiro to Paris with a connection in Madrid. The round trip cost $118. The passengers received the confirmation of their purchase, which included a booking number. In a one-sided move days later, Iberia canceled hundreds of tickets.

Providers must comply. They could perhaps claim there was an error issuing the ticket, arguing prices were far below their market value. However, air tickets oscillate significantly. You can’t claim consumers acted in bad faith by purchasing tickets at a lower price

Now, the inquiry should look into whether Iberia’s conduct was abusive in placing consumers at excessive disadvantage with no appropriate or accurate information.

Even though the company is based out of the country, the firm must comply with Brazil's Consumer Code. "Consumers must seek the judiciary after procuring evidence -the tickets issued and subsequently canceled. The fact that the air carrier is foreign should not make access to authorities difficult for Brazilian consumers".
